Real Estate Commission: How it Works

Although it is possible to purchase or sell real estate independently, both parties commonly approach the deal with professional representation from a registered Realtor.

Similar to other transaction-oriented industries, professional real estate agents do not earn an hourly wage or annual salary. Rather, they are compensated through commission. 

In Ontario, real estate commissions are typically structured as a percentage applied to the final sale price of the property. This practice is largely ubiquitous among top-producing agents. 

Less commonly, some Realtors charge clients a flat fee for their services. Hybrid commission structures (flat fee plus a percentage of sale price) also exist as well. 

Note that the Real Estate Council of Ontario (RECO) does not permit agents to charge commission based on a sliding scale. Further, they may not apply separate commission rates based on a difference between the initial listing price and final sale price.

Who Pays Commission?

Buyers and sellers have differing financial obligations related to a real estate transaction, and only one party will pay for their agent’s services directly. 

When a house is bought and sold, all associated commissions are paid for by the seller. This includes commissions earned by the buyer’s agent. 

Here is how it works: 

As a transaction closes, the seller pays a percentage-based commission to their Realtor based on the final sale price of the property. From there, the seller’s agent divides these earnings among themself and the cooperating buyer’s agent. 

How Commission is Paid

Sellers do not pay commission to their real estate agent directly. The funds are instead collected by the agent’s brokerage at closing, typically via the seller’s lawyer. The brokerage pays the buyer’s agent once the money has been received. 

What is the Average Real Estate Commission in Ontario?

While some sales and service-based industries in Ontario have a ‘standard rate’ for professional commissions, real estate does not. Rather, Realtors are free to set their own commission rates based on their professional stature, degree of expertise and service, investment in individual listings, and other similar variables. 

In the Toronto market, commission rates typically range between 3% and 6% on average. 

Home sellers should always ask a potential agent about their commission rates and structure before signing a listing agreement. 

Are Real Estate Commissions Subject to HST?

Like all professional services, real estate commissions and other related fees are subject to harmonized sales tax (HST).
