Defining Estate Sales
Estate sales differ from a traditional home sale in many ways. When a homeowner passes away, the property can not simply be claimed and sold on a first-come, first-served basis.
Unless the individual is survived by a co-owner of the property (such as a spouse) or alternative arrangements are provided in the Will, the house along with other significant assets become part of the estate. This impacts how the property can be managed and sold. Hence the term estate sale.

Confirm Your Role
Depending on the circumstances, more than one person may wish to be involved in planning the estate sale. If you will be working with other relatives or close family friends as you sell the property, it is essential to clearly define everyone’s role before the sale process is initiated.
Beyond outlining each person’s individual responsibilities, maintaining open and transparent dialogue between everyone involved helps to avoid misunderstandings and interpersonal frustrations.
Generally, the Will’s named executor or estate trustee (often the deceased’s next of kin or another immediate family member) will lead the selling process, with other parties lending support along the way. However, anyone with a connection to the homeowner may do so if they have the legal authority. More on this later.
Engage an Expert
Just as if you were selling your own property, the best place to formally begin an estate sale is by hiring an experienced, full service real estate agent. Ideally, you should select a professional who has specific experience with estate sales. The more insight they have into your needs, the better they can support you.
Often executors are tasked with selling a loved one’s home from another community, city, or even province. If you do not live near the property, choose an agent who is local to that area as opposed to near you. As you interview and vet potential agents, inquire directly about remote sales experience if that is relevant to you.
Proceed With Probate
Probate is a necessary step for most estate sales (although exceptions do apply). If you have been named as an executor or estate trustee within the homeowner’s Will, you must have that title confirmed by the Province of Ontario before you can officially delegate or sell property belonging to the estate. This process is called probate.
In Ontario, probate can take weeks or months to be finalized. Undertaking the process as early as possible can reduce the odds of delays or other complications with your estate sale.
Ontario’s Estate Administration Tax
Note: There is a cost associated with completing probate. Known as Ontario’s Estate Administration Tax, applicants are taxed based on the assessed value of the estate. This often adds up to tens of thousands of dollars.
Preparing the Home For Sale
With the legal aspects of your estate sale managed, turn your attention to the home itself. In any real estate market, accomplishing a fast, high-return sale requires property optimizations.
Managing Existing Belongings
Begin with a thorough decluttering and depersonalization of the property. This includes removing outdated furnishings, overly personal decor items, and any other belongings that may hinder the house’s desirability. Your agent can offer guidance on which items should be removed and which should stay.
Repairs & Upgrades
Next, make any necessary repairs throughout the home. Your agent can also recommend other projects or upgrades that will positively affect property value.
Cleaning & Staging
Perform a meticulous deep clean of the house. If you do not have the time to do so or do not live close to the property, consider investing in professional cleaning services. Once it has been cleaned, your agent will stage the property, fine-tuning the ambience to really impress potential buyers.
